Former insiders describe a deliberate dismantling of the agency’s teeth following the 2024 election. Jeff Le Riche, a veteran enforcement lawyer, suggests that the Trump administration sought to signal a friendlier environment for the crypto industry by purging officials who had pursued aggressive cases against firms like FTX and Gemini. Former attorney Joe Konizeski recalls being told that all crypto related cases were simply being closed, leading to a mass departure of high performing lawyers who felt their missions had been compromised. Some critics point to a revolving door between regulators and industry players as evidence of this shift, noting that former leadership transitioned directly into executive roles at major cryptocurrency companies.

This retreat from regulation extends beyond digital coins and tokens. Sources say the lack of personnel has forced the commission to abandon unrelated fraud investigations, including foreign exchange scams involving millions of dollars. There are growing concerns that this vacuum provides an open invitation for predatory behavior, specifically regarding how prediction markets like Polymarket and Kalshi advertise to young audiences. Without enough cops on the beat, veterans warn that deceptive practices will likely proliferate unchecked across these volatile markets.

The situation has caught the attention of Capitol Hill and federal watchdogs. Senator Elizabeth Warren recently called for an investigation into whether the agency is still capable of functioning as a market protector or if it has effectively been sidelined. The Government Accountability Office is now launching a formal probe into these workforce reductions to determine why such a vital regulator has shrunk while its jurisdiction grew exponentially. While the CFTC claims it plans to hire around 100 new employees by late 2026, skeptics wonder if those efforts can keep pace with an increasingly complex financial frontier.
