US backs Elon Musk’s bid to overturn €120m EU fine against X

The United States government has stepped into a high stakes legal battle between Elon Musk and the European Union, filing an application to help X overturn a 120 million euro fine. The dispute centers on the social media platform’s controversial blue checkmark system, which the European Commission claims deceives users by selling verification badges without meaningfully confirming the identity of the account holders. While Brussels views this as a necessary enforcement of consumer protection laws, Washington sees it as an overreach of authority.

Assistant Attorney General Brett A. Shumate argued that the European Commission has inappropriately tried to extend its power over American companies operating outside its direct control. By intervening in the case before the EU General Court, the Department of Justice aims to protect U.S. headquartered digital services that contribute significantly to the domestic economy. Officials claim there is a clear national interest in ensuring that international law regarding territorial jurisdiction is respected and that American firms are not unfairly prejudiced by foreign regulations.

This diplomatic escalation reflects a broader tension between Silicon Valley and EU regulators. Secretary of State Marco Rubio echoed these sentiments, describing the fine as an attack not just on X but on all American tech platforms and citizens. Musk himself has long complained that Europe’s stringent tech regulations inhibit innovation and progress, recently aligning his rhetoric with those calling for an end to what they describe as foreign censorship of American voices online.

On the other side of the Atlantic, European officials remain steadfast in their position. Spokesperson Thomas Regnier stated that the commission possesses a solid case rooted in breaches of the Digital Services Act, noting that X has also been criticized for lacking advertising transparency and blocking researcher access to data. Executive Vice President Henna Virkkunen emphasized that deceiving users and evading accountability have no place within the EU market, maintaining that these rules apply equally to all platforms regardless of where they are based.
